Nationally recognized for its expertise in Investor Visa Options.
The United States has several immigration options which allow foreign investors and entrepreneurs to pursue the goal of living, working and investing in the U.S.
EB-5 Investor Green Cards
Tristani Law has significant expertise and experience helping thousands of individuals and families obtain EB-5 green cards. The EB-5 Immigrant Investor Program was created by Congress more than 30 years ago to stimulate the U.S. economy through foreign investment and job creation. The EB-5 program provides a path towards U.S. permanent residence for individuals who invest at least $800,000 in a commercial enterprise located in a targeted employment area (TEA), a rural or high-unemployment area or $1,050,000 in a project not located in a TEA. This investment must create at least 10 permanent full-time jobs for qualified U.S. workers.
There are two investment options for EB-5 investors. Investors can pursue the direct investment model by starting their own business or investing in a project that will directly employ ten full-time workers. Individuals can also invest in a Regional Center project where the EB-5 investor invests in a project that is sponsored by a USCIS approved Regional Center that will result in indirect job creation for ten U.S. workers.
For investors and entrepreneurs who are looking to live in the U.S. permanently, Tristani Law provides strategic and detailed advice to help its clients navigate this complex immigration process. We assist EB-5 clients in vetting and selecting EB-5 Regional Centers, designing EB-5 qualified company structures and creating investment plans for new businesses. We also help our clients with their path and source of funds for the EB-5 investment as well as completing the I-526 petition, consular processing/I-485 adjustment of status and the I-829 petition.
E-1 and E-2 Nonimmigrant Visas
E-1 and E-2 visas are available to individuals who are citizens of countries that have signed international trade and investment treaties with the United States. These treaties allow for certain foreign nationals to obtain E-1 treaty trader or E-2 treaty investor visas to temporarily live, work, invest, or start a business in the U.S.
For investors who are looking to the live in the U.S. temporarily or are seeking an alternative to the higher investment threshold of the EB-5 green card, E-2 visas provide a flexible solution and are renewable indefinitely. Tristani Law assists its E-1 and E-2 clients with path and source of funds analysis, designing qualified E-2 company structures, franchise selection, consular processing, and change/extension of status with USCIS.
